Employers' liability insurance Under the Employers' Liability (Compulsory Insurance) Act 1969, every employer must insure against legal liability for bodily injury or disease sustained by his/her employees arising out of, or in the course of, their employment. Failure to do this is a criminal offence. AmountThe minimum amount of employers' liability insurance is 2 million pounds sterling in respect of any one claim, and the policy must be effected with an authorised insurer: ie a person or company carrying on an insurance business relevant for the purposes of Part 2 of the Companies Act 1967. A list of authorised insurers is available from HMSO. Availability of policyThe policy document or a copy must be kept available for inspection by a person authorised by the Health and Safety Executive who administer and enforce the Act. A copy of the certificate of insurance must also be displayed at the employer's place(s) of business so that it can be seen and read by all his/her employees. As with public liability insurance, all proprietors are advised to discuss their insurance requirements with their broker so that they may be sure of being adequately insured against all risks which may reasonably arise. Health and safety at work 'Six Pack'These new regulations came into force at the beginning of 1993 and implement six EC directives. They place responsibilities on all employers for their employees and others who may be affected by the work activities on their premises. The self-employed also come within the scope of the regulations. Broadly speaking, the regulations reinforce existing health and safety legislation. Their overall emphasis is on effective health and safety management and employers are made responsible for assessing risk and installing the appropriate safety measures.
